(PCM) The surviving members of the Beastie Boys have come out victorious being awarded $1.7 million dollars from their lawsuit against Monster Energy Drink.
The lawsuit was initially filed by the Beastie Boys back in 2012 after they discovered that Monster Energy Drink was illegally using the group’s music in a promotional video. The group were initially suing for $2.5 million for copyright infringement and false endorsement. Lawyers for Monster Energy Drink claim that they are planning to appeal the verdict.
Monster Energy Drink allegedly used the Beastie Boy’s songs “Sabotage”, “So, Wha’cha Want”, “Make Some Noise” and “Looking Down The Barrel Of A Gun” for the promo video which was featured on the company’s website. There was also reportedly a 23-minute compilation of Beastie Boys tracks made available as an Mp3 download on the site as well.
Monster Energy admits that they infringed on the Beastie Boys copyright, however they feel the most they should owe would in the range of $125, 000 and claim that the Beastie Boys claim of irreparable damage as being illogical.
One of the other major factors behind the lawsuit on the Beastie Boys side was the fact that late band member Adam Yauch, who passed away in May 2012, shortly before the lawsuit was filed, had a will the specifically prohibited any company from using the bands music for advertising purposes.
